MONTGOMERY ADVERTISER – CRONIER’S FINE JEWELRY PERFECT PROPOSAL OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. Eligibility. Subject to the additional restrictions below, the Cronier’s Fine Jewelry Perfect Proposal is open to Alabama residents who are 21 years or older at the time of entry. Employees of Cronier’s Fine Jewelry, Montgomery Advertiser, the Advertiser Company, Inc., Gannett Co., Inc., and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with any such employees, are not eligible to enter or to win.

3.How To Enter. The Contest begins January 18, 2012 and ends February 14, 2012. Submission period is from January 18, 2012 at 6:01:00 AM to January 31, 2012 at 11:59:00 PM. Register at http://www.montgomeryadvertiser.com/perfect. Follow all directions on the registration form, and be sure to fill in all the required fields. Type your original Essay of 500 words or less of your perfect proposal. You must provide a valid email address. All submissions must be received by midnight, January 31, 2012 to be included in the voting. Automatic disqualification will occur for profanity or socially unacceptable content.

4.Winner Selection by Online Voting: Readers can vote for their favorite story by visiting www.montgomeryadvertiser.com/proposal, registering to vote, then reading each entrants Essay, and voting. To submit a vote follow all posted instructions and click “submit”. Voting will begin at 6:00 AM, (C.S.T.) on February 1, 2012 and end at 6:00 PM on February 13, 2012. The submission with the most votes at the end of the voting period will be declared the Grand Prize Winner. In the event of tie, the winner will be selected by Cronier’s Fine Jewelry in a random drawing from among the tied entries.

You may submit only one (1) vote for one (1) Essay each day of the contest voting period.

Sponsor will not be responsible for incomplete, lost, late, or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. Ad blocking software on your computer needs to be disabled so that it doesn’t interfere with processing your entry. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. Contestants acknowledge and agree that Sponsor shall have the right to edit, adapt, modify, reproduce, publish, promote, or otherwise display or use entries in any way it sees fit without limitation or compensation to entrants.

By entering your original Essay submission, any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. Sponsor further reserves the right to disqualify any entry that is alleged to infringe on any third-party’s intellectual property rights, or that Sponsor deems obscene, offensive or otherwise inappropriate for viewing by a general audience.

You grant the Newspaper, and anyone authorized by the Newspaper, a non-exclusive, irrevocable and royalty-free license to reproduce, transmit, distribute, publicly perform, and otherwise use the Essay, in whole or in part, throughout the world in perpetuity in connection with the Newspaper Site, including, without limitation, for permanent storage and real-time transmission on or in connection with the Newspaper Site, for the purpose of making the Essay available on the Newspaper Site and permitting end-users of the Newspaper Site to access, and copy the Essay.

You also grant the Newspaper, and anyone authorized by the Newspaper, a royalty-free license to reproduce and use your name(s), likeness(es), image(s) and the name of your Essay (together with all trademark rights therein, the “Publicity Rights”) on or in connection with the use of the Essay in any and all promotional or advertising material related to such use. The Newspaper shall have no obligation to use the Essay, in whole or in part.

You understand and agree that you will not receive any monetary compensation as a result of any such use of the Essay, and/or Publicity Rights and that you will not be entitled to any royalty or additional compensation in connection with this Agreement.

Except with respect to the license granted to the Newspaper, you will retain all rights, title and interest in and to the Essay, including without limitation, any and all copyright and other proprietary or intellectual property rights contained therein. You acknowledge and agree that the Newspaper has no control over the use of the Essay by third parties who access these materials on the Newspaper Site and that you will bear any risk and liability in the event that any such third parties make uses of the Essay.

You represent and warrant that you are the sole author(s) of the Essay; you are the sole owner(s) of all rights in or otherwise have the right to license the Essay and the Publicity Rights; you have the full right and authority to enter into this Agreement and to grant the Newspaper the rights granted in this Agreement; and the Newspaper’s use of the Essay, or the Publicity Rights as contemplated under this Agreement will not infringe or violate the rights of any third party, including without limitation, any copyright, trademark, or right of privacy or publicity. These representations and warranties shall survive the termination of this Agreement for any reason.
You agree to indemnify and hold the Newspaper, Gannett Co., Inc., and their respective affiliated entities, licensees, successors or assigns, harmless from and against any and all third party claims, and any and all liabilities, losses, damages, costs and expenses (including, without limitation, reasonable attorneys’ fees) arising from or relating to your breach or alleged breach of this Agreement. The Newspaper shall have the right, at its sole option, to defend and/or settle any such claim, demand, suit, action, or proceeding on such terms as it deems advisable. These indemnification obligations shall survive the termination of this Agreement for any reason.

This Agreement is not intended to create a partnership or joint venture between the Newspaper and you. This Agreement constitutes the entire agreement between the Newspaper and you with respect to the subject matter contained in this Agreement, and supersedes any prior agreements, representations or understandings, whether written or oral, by the parties with respect to such subject matter and may be amended or modified only by the parties’ mutual written consent. This Agreement shall be governed and construed in accordance with the laws of the State of Alabama, without regard to its choice of law provisions.

5. Prizes and Odds. One (1) Grand Prize Winner will receive a set of rings from Cronier’s Fine Jewelry valued at $825 MSRP . Odds of winning are dependent on the number of eligible entries.

6. Winner Notification and Acceptance. Winner will be notified on or about February 14, 2012 at the telephone number, email address and/or U.S. Mail address provided on the registration information provided during the submission process of the contest. Sponsor will call during regular business hours at number provided on entry form. Failure to reach winner may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. Cronier’s Fine Jewelry will also telephone the winner to confirm prize pick up time after they have been notified. Winners may waive their right to receive prizes. Prizes are non-assignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation.

7. Participation. By participating, contestants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award the prize based on the original selection criteria submitted by each band.

8. Copyright. By entering the Contest, each contestant grants to Sponsor an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the contestant’s submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation. Each contestant further agrees that if his/her entry is selected by Sponsor as the winning entry, he/she will sign any additional license or release that Sponsors may require, and may be asked to not publicly perform or display his or her submission without the express permission of Sponsor.

9. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

10. Sponsor. The Cronier’s Fine Jewelers Perfect Proposal Online Contest is sponsored by the Montgomery Advertiser and Cronier’s Fine Jewelers. The decisions of Sponsors regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
